1. Agreement to Terms

By accessing or using the services provided by Schlickmann Construction ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Services Description

Schlickmann Construction provides licensed general construction and renovation services for residential and commercial properties in Massachusetts and Southern New Hampshire. Our services include:

• Kitchen remodeling, bathroom renovation, and ADA accessible bathrooms
• Home additions, second-story builds, and full-home renovations
• Custom homes and ground-up construction
• Basement finishing, decks, patios, and outdoor living spaces
• Custom carpentry, built-ins, and finish work
• Architectural design services and permit-ready plans
• Commercial build-outs and church / religious-building renovations

3. Service Agreement

3.1 Quotes and Estimates

All quotes provided are fixed-price proposals based on the scope, drawings, and selections agreed at signing. Changes during construction are handled through written change orders signed by both parties before the work proceeds.

3.2 Scheduling

Project start dates depend on permit approval, material lead times, and crew availability. We communicate schedule changes promptly and work to minimize disruption to your home or business.

3.3 Property Access

By engaging our services, you grant our team access to the project area during agreed working hours. You are responsible for clearing the work area, securing pets and valuables, and ensuring utility access where work will be performed.

4. Payment Terms

• A signing deposit is required to schedule the project and order long-lead materials
• Progress payments are tied to defined milestones in the contract
• Final balance is due at substantial completion and walkthrough sign-off
• We accept ACH, check, credit card, and approved financing
• Late payments may incur interest charges as permitted by Massachusetts law
• Returned checks will be subject to a $35 fee

5. Cancellation Policy

• Cancellations within the Massachusetts statutory three-business-day right-of-rescission window: full refund of deposit
• Cancellations after rescission but before materials are ordered: refund minus design / engineering work performed
• Cancellations after materials are ordered or work has begun: customer is responsible for materials, labor, and restocking fees incurred to date

6. Warranty and Liability

6.1 Workmanship Warranty

We warrant our workmanship for one (1) year from substantial completion. Defects in workmanship reported in writing during this period will be corrected at no charge. Manufacturer warranties on cabinetry, appliances, fixtures, and materials apply per the manufacturer's terms.

6.2 Customer-Supplied Materials

When using customer-supplied materials or fixtures, we are not responsible for product defects, missing parts, or installation issues caused by the customer-supplied item. Replacement materials and additional labor are billed at standard rates.

6.3 Limitation of Liability

Schlickmann Construction's liability is limited to the contract value. We are not liable for indirect, incidental, or consequential damages arising from our services.

7. Property and Safety

• We protect floors, finishes, and adjacent rooms with daily site protection and cleanup
• Minor cosmetic touch-ups (paint blemishes, dust) are part of normal construction; final punch list addresses anything outstanding
• Please inform us of any pre-existing structural, electrical, or plumbing concerns before work begins
• We carry $2M general liability insurance and full workers' compensation coverage

8. Intellectual Property

All content on our website, including text, images, logos, and designs, is the property of Schlickmann Construction and is protected by copyright laws. You may not reproduce, distribute, or use our content without written permission.

9. Customer Responsibilities

As a customer, you agree to:

• Provide accurate property information for quotes
• Ensure electrical outlets are functional and accessible
• Notify us of any changes to your property or requirements
• Keep the work area reasonably clear and accessible
• Inform us of any HOA or community restrictions

10. Force Majeure

We are not liable for delays or failure to perform due to circumstances beyond our control, including but not limited to natural disasters, severe weather, power outages, pandemics, or government restrictions.

11. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through good faith negotiation. If resolution cannot be reached, disputes will be subject to binding arbitration in the Commonwealth of Massachusetts.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified Terms.

14. SMS Terms & Conditions

Schlickmann Construction provides SMS communications related to construction services, estimates, project updates, appointment reminders, customer support, and follow-ups regarding inquiries submitted through our website or advertising campaigns.

You can cancel the SMS service at any time. Just text "STOP" to (978) 608-3636. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages.
